Insolvency administrators of a commercial property rental company refused to pay investors rental expenses, due to them, on the grounds on these investors’ nationality or citizenship.
The administrators were explained that, according to the Equality Act 2010, they must not discriminate investors on the grounds of their race, that under the Equality Act a race means colour, ethnic origins and nationality (including citizenship). Further they were advised that their suggestion not to pay people because of their nationality means the breach the company voluntary arrangements which means that the company may go into liquidation.
